Del City Board tables garage-to-living-space variance at 4713 Crest Place after applicant absence

The Del City Board of Adjustment opened its July 13, 2026 meeting and took up a building code variance request to convert a one-car garage at 4713 Crest Place into a mother-in-law/primary suite, then tabled the application until the board's next regularly scheduled meeting on Aug. 10, because the applicant was not present.

Clerk presented the application, identifying the applicant as Kit Heron and describing the property as having a current one-car garage and a driveway that fits two cars. The clerk said, “City staff does recommend denial of BABCV219-26, the garage conversion at 4713 Crest Place. Staff would recommend approval of the request with the addition of a storage building in the back.”

During discussion, the chair said he had driven by the property and that “it looks like something has already started,” and noted he could not tell whether anyone was living there or whether a permit had been issued. The board opened the public portion of the hearing by motion and voice vote and then closed it when no members of the public were present.

Because the applicant was not in attendance to answer questions about the project and documentation, a board member moved to table a decision on BABCV219-26 until the board’s next meeting; another member seconded the motion and the board approved it by voice vote. The board set the matter for the Aug. 10 meeting so the applicant could appear to respond to questions and provide any requested clarifications.

The public hearing was opened and closed by vote before the board took the procedural step to table the item. No formal vote on the variance was taken at the July 13 meeting. The item remains pending pending the applicant’s appearance and any additional information the board may request.
