The West Yarmouth Conservation Commission met May 7 and took a series of administrative and enforcement actions, including levying a $300 fine for an after‑the‑fact stair replacement and approving multiple certificates of compliance with conditions.
Commissioner David Bernstein moved to issue a $300 fine and continue the after‑the‑fact filing for replacement stairs and a boardwalk at Great Island Road (SE83‑2532) to June 4 so the applicant could submit a revised plan including restoration of disturbed dune and beach vegetation; Commissioner Paul Huggins seconded the motion and it carried 6‑0. Commissioners said notice of violation had been sent a year earlier and discussed fines and potential removal if an NOI were denied.
The commission also issued several Certificates of Compliance (COCs), many conditioned on follow‑up actions: two COCs for work on John Fedele’s property (SE83‑2017 and SE83‑2107) were issued after the agent reported compliance and debris removal; a COC for Carolyn Couture’s property (SE83‑2097) was approved but held pending an Administrative Review to address an unpermitted pervious walkway; and a COC for Mark Stoever’s property (SE83‑2266) was granted pending the planting of a 1.5–2" caliper native tree.
For Anthony Campagna (SE83‑76), the commission issued the COC contingent on the applicant filing a future NOI that would permit or require removal of unpermitted patio/hardscape; that motion passed 5‑1. Several hearings were continued to May 21, 2026 (including SE83‑2529, SE83‑2531 and the COC for SE83‑75) to allow applicants to address staff comments or provide additional information.
Earlier on the agenda the commission issued a Negative 2 determination for a proposed addition at 96 South Shore Drive (Lourival Santos) pending a revised plan and accepted standardized conditions for other ongoing projects. The meeting closed after approval of minutes and a brief update from Chair Bernstein on the Coastal Resiliency Fair and drought outreach; the commission adjourned at 6:43 p.m.
The $300 fine and continuance give the applicant a chance to submit a revised plan and vegetation restoration; the commission will revisit the item on June 4.
