Gilmanton ZBA approves roadside-setback variance for garage at 5 Iris Ave

The Gilmanton Zoning Board of Adjustment voted 4-0 on Jan. 15 to approve a variance allowing a single-story garage to be built within the roadside setback at 5 Iris Ave.
Applicant Peter G. Kotsakis, trustee of the Peter G. Kotsakis Trust, told the board the garage would be sited to the side of the house and one story tall. Board Chair Elizabeth Hackett confirmed members had visited the property and that the town’s septic location had been verified. The board recorded dimensions for the approved structure: 12 feet wide, 20 feet long and about 15 feet high, and no closer than 10 feet from the property line along Iris Avenue.
Chair Hackett said town department heads received the application and that the fire chief reviewed it and had no concerns. The Sawyer Lake Village District (SLVD), which plows Iris Avenue, was also notified; Mr. Kotsakis told the board that Bob Dow of the Village District is aware of the proposal and had no objection. During the public hearing Michael Griffin voiced support for the project; Michael Kehoe clarified which entity maintains paved and unpaved roads within the district.
During deliberations Member Zannah Richards moved to approve the variance, citing the corner-lot constraints that limit suitable locations for outbuildings and finding the request meets the statutory hardship and other approval criteria. Member Leslie Smith seconded and the motion passed unanimously. No additional conditions were attached to the approval.
The board’s approval was recorded as fulfilling the required findings that the variance would not be contrary to the public interest, would observe the spirit of the ordinance, would do substantial justice and would result from a property-specific hardship related to the lot’s configuration. The hearing record lists the property as Map & Lot 119-037 in the Residential Lake Zone.
