Special magistrate issues multiple findings, sets Dec. 13 compliance dates and fines

New Smyrna Beach’s special magistrate issued a series of code-enforcement findings on Nov. 13, ordering multiple property owners to correct violations by Dec. 13, 2024, and setting daily fines for continued noncompliance.
Officer John Parks presented several cases. For 999 B Street (CCSM0643-2024), Parks said new fencing and siding were installed without permits; the magistrate ordered correction by Dec. 13 and set a $50-per-day fine to begin if the work is not permitted and inspected. For NSB Medical Plaza at 161 North Causeway (CCSM0679-2024), Parks described a rusted canopy supported by temporary jacks; a permit application was recently submitted but has not yet been reviewed. The magistrate ordered correction by Dec. 13 and set fines at $200 per day for continued noncompliance.
At 720 South Dixie Freeway (CCSM0710-2024), code compliance reported signage installed in the right of way and a Business Tax Receipt that does not reflect the business activities observed. Staff recommended finding Orchard Holdings LLC in violation; the magistrate ordered correction by Dec. 13 and set $50-per-day fines for specified violations. For the business-tax-related finding (section 74-146), staff recommended a finding of noncompliance without a daily fine until the property is brought into full compliance.
Ocean Trillum South COA (CCSM0675-2024) was singled out as a life-safety priority. The code inspector described long-standing elevator and fire-door problems and told the magistrate the property remains noncompliant; the magistrate ordered corrective action by Nov. 29, 2024, and warned of a $250-per-day fine thereafter.
Several other matters were withdrawn or continued: the case for 118 Douglas Street was withdrawn, and multiple cases were continued to a future February 2025 hearing date.
Property owners and representatives were ordered to contact the code inspector to verify compliance and to pull required permits for major repairs. Fines listed by the magistrate will accrue per day for each continuing violation after the compliance dates.
