Council delegates authority to initiate condemnation for Leon River interceptor easements

Staff presented the Leon River interceptor phase 2 wastewater project and asked council to delegate authority to the city manager to file condemnation petitions if negotiations for required easements are unsuccessful. The project is an 8,550-linear-foot, 30-inch PVC wastewater gravity interceptor designed to connect the city's treatment plant to the Poison Oak lift station.
Staff said 17 of 29 required easements have been acquired; 12 remain and are expected to require further negotiation, with appraised values ranging from about $2,100 to $32,400 and average and median values near $10,000. One parcel may require condemnation because of unknown owners/title defects. Staff explained the statutory condemnation process: appraisal, initial offer, negotiation, final offer, special-commissioner hearing, and, if necessary, litigation.
Council voted unanimously to delegate to the city manager the authority to initiate condemnation petitions in order to help meet project timelines, while staff emphasized that delegation does not obligate the city to file petitions and negotiations will continue.
