Board reinstates Kirk Wolters with conditions and approves amended consent order for Charles A. Tocco

Kirk Wolters appeared in person seeking reinstatement of a certificate and permit that had been revoked for failure to complete required continuing education. The board entered closed session to deliberate and reconvened to approve the reinstatement application on conditions: Mr. Wolters must first complete 158 hours of acceptable continuing education and provide proof acceptable to the board chair and executive director; the CE hours required by the reinstatement cannot be used for future renewals; Mr. Wolters will be subject to a mandatory CE audit for the next five permit renewal cycles; and he must reimburse the board’s costs under K.S.A. 1-206, including attorney and court reporter fees. General Counsel Darin M. Conklin was directed to issue a Final Order memorializing these conditions.

In a separate disciplinary matter, Charles A. Tocco appeared virtually on a stipulation and consent order arising from a determination that he failed to maintain permit-renewal requirements and did not timely provide required proof of CE. Investigator Julie Wondra recused from the matter. The board amended and approved the stipulation and consent order to set a new deadline of Dec. 31, 2024 for submission of acceptable proof of the required 18.5 CE hours, increased the fine to $1,000, required mandatory CE audits for the next three permit renewal cycles, ordered reimbursement of board costs pursuant to K.S.A. 1-206 (including attorney and court reporter fees), and issued a censure.

Both matters were resolved by recorded motion and vote; the minutes record motions, seconders and final outcomes, and direct board authority to impose conditions and recover costs under K.S.A. 1-206.
