Board forms work group to review and modernize nursing statutes

The Kansas State Board of Nursing investigative committee said Sept. 4 that it will convene a work group to review selected statutes and prioritize possible revisions to help the board’s investigative and disciplinary processes.
Brenda Sharp, public member and vice chair, told the committee she and staff convened an initial work group to examine statutes “primarily around KSA 65, 11 20, 11 28, 11 21 8, 11 29, 11 10, 60 through 60‑3, 1 10,” and an impairment statute, and to recruit outside members to provide broader feedback. “We’ll be recruiting additional members including some external to the organization to be sure that we’re getting good feedback,” Sharp said.
Sharp said the group’s aim is to analyze and compare Kansas law to other states and national best practices; she said the committee does not expect to pursue changes in the immediate legislative session and plans roughly a year of review. “We don’t anticipate pursuing anything in the upcoming legislative session, but rather taking about a year to review, analyze, research, compare to other states, [and] look at best practices,” she said.
Staff reported the attorney general’s office and the board’s general counsel will participate in the work group. Committee members discussed the practical and political realities of statute changes and emphasized that any revisions must preserve public protection and avoid unintentionally narrowing the board’s oversight.
The committee asked staff to continue research and to bring recommended priorities back for discussion before moving toward formal rulemaking or legislative drafting. The committee did not take legislative action at this meeting; members asked for additional background materials and timelines at a future meeting.
