Township finalizes Fair Share Housing consent order; will seek judge’s entry

Township legal staff announced at the July 13 meeting that Livingston finalized a consent order with the Fair Share Housing Center for the municipality’s fourth-round fair-share housing obligations.
Jared reported the consent order will be filed with the court for the judge’s review and entry. “If you have a consent order at Fair Share Housing Center, the court enters it,” Jared said, and the township expects entry to provide a 10-year period of immunity with a five-year midpoint review. Staff said the consent order was finalized and would be forwarded to the judge for review and likely entry based on prior experience.
Council members thanked staff and others who worked on the agreement. Jared described the consent-order path as “the easier route” compared with litigated resolution, and said entry would conclude the township’s 4th‑round process absent future litigation or material changes.
Next steps: staff will submit the consent order to the court for review and entry; if entered the township would operate under the terms of the consent order and track the five-year midpoint review.
