Community development staff (Jeff) told the council the purchase agreement for a 4.92-acre parcel on Delafield Street (formerly listed as 1320318 Delafield Street) was first presented in January 2024 and has had two previous amendments. Staff recommended a third amendment to extend the due-diligence period and set a closing deadline no later than one year after two triggers: conclusion of the pending lawsuit (or exhaustion of appeals) and approval and recording of a required conservation easement because the site is part of a historic area.
Jeff said the buyer would then have one year after both triggers occur to close. Council members asked clarifying questions about the triggers and timing. An alderperson moved to approve the amendment as recommended by Community Development; the motion carried with 11 votes in favor, one no vote and one abstention.
The council did not attach additional conditions to the amendment at the meeting. Staff indicated the conservation easement must be drafted, approved, and recorded before the one-year clock would begin.
