The Fountain City Council approved on first reading Ordinance 18-22, a text amendment to the municipal zoning code that reduces side-yard setback requirements in the Regional Commercial zone when a lot abuts another Regional Commercial lot.
Planning staff said the change is narrowly targeted to regional commercial corridors—such as Mesa Ridge Parkway and portions adjacent to I-25—and is intended to reduce unused "dead space" and help attract large retail and commercial investment. Under the proposed amendment, the standard 20-foot side-yard setback would remain where a commercial lot abuts a non-commercial or residential parcel; where two Regional Commercial lots abut, the side yard could be reduced to zero, subject to building code requirements.
Staff noted fire-safety standards would apply: many large commercial buildings in the zone will be required to be sprinklered and fire-rated, and site development rules (easement protection, parking and circulation review) still apply. Planner Brodhead said the change mirrors common practice in other cities and is designed to streamline development without eliminating safety review.
Council moved and seconded the ordinance on first reading; the clerk recorded seven yes votes and the motion carried. The ordinance will next return for a required second reading and final vote.
