Council approves $510,094 sidewalk contract for Washington Elementary after low-bid rejection

Senior civil engineer Steve Bettencourt told the council that the Washington Elementary School sidewalk project (City Project R93/CML5157119) will construct new sidewalks, drive approaches and ADA access ramps along Delaval and Austin Avenues between Lincoln and Cleveland Avenue to improve safe routes to school.
Bettencourt reported 11 bids were received. He said the apparent low bidder, JT2 Incorporated (doing business as Todd Companies), submitted a bid bond that omitted required dollar‑amount language and therefore was deemed nonresponsive and rejected. "This omission renders the bond unenforceable," Bettencourt said. The next lowest responsive and responsible bidder, Villalobos and Associates Incorporated, submitted a bid of $510,094.38 and met all documentation requirements; staff recommended awarding the contract with a 10% contingency for unforeseen conditions.
Bettencourt also said a preliminary environmental assessment determined the project is categorically exempt under CEQA Guidelines section 15304(c) for minor alterations to existing facilities that do not expand capacity. Council members thanked staff for outreach to property owners at a June 23 public information meeting and for competitive bid coverage. There was no public comment and the council moved to approve the contract award and CEQA exemption. The motion passed unanimously.
The city will award the contract to Villalobos and Associates Inc., include a 10% contingency, and proceed with project implementation per the adopted resolutions.
