Representatives for the applicants explained the parcel is split across municipalities and that the proposed driveway runs near a DEC Class C stream, which creates permitting requirements under local wetland and floodplain rules as well as state MS4 stormwater coverage. The town engineer and applicant discussed a history of partial, now‑stopped work on the site; staff said a highway permit from the town would be issued only after wetland, floodplain and MS4 approvals are in place.
Given the cross‑jurisdictional complexity, the board voted to record a Type II determination for its SEQR-equivalent process and to schedule a public hearing on August 20 to receive public comment and finalize any required local actions. Staff will prepare a draft resolution to be tailored following the public hearing.
