Kansas Board of Accountancy accepts multiple stipulations and consent orders, imposing fines and censures

The Kansas Board of Accountancy on Aug. 23 accepted a series of stipulations and consent orders resolving investigations into alleged unlawful practice and related cooperation matters.
In one matter the Board found that JP Golway Tax & Accounting, Hansen Tax Services and Financial Designs Tax Services engaged in the practice of certified public accountancy without valid firm registrations and that the named individuals violated practice statutes. The order required each respondent individual to pay a $1,500 fine plus costs, each respondent firm to pay a $1,500 fine, approval of the firms' registration applications, and censure. Jeffery Bottenberg, the investigator, recused himself from the matter; the Board went into closed session to deliberate and later accepted the stipulation as amended to add the phrase "Financial Services" after "Financial Designs."
In a separate case the Board accepted a stipulation with Richard Todd Gabel and his firm finding unlawful practice; the individual fine was $500 with $250 assessed to the firm upon receipt of a firm registration application filed by Aug. 23, 2019; Bottenberg recused from that matter.
The Board also accepted a stipulation with PSK, LLC finding a failure to cooperate in a timely manner with an investigation; the order required appearance and a $500 fine and costs. The Board amended paragraph 6 to cite K.S.A. 1-312(6) rather than K.S.A. 1-312(5); investigator Sean P. Weaver recused himself from participation.
Finally, the Board approved a stipulation with Molly Mattingly Breitenbach finding she practiced without a lawful Kansas certificate and valid permit; the order required a $500 fine and costs, approval of her application for a Kansas certificate and initial permit, and censure. Bottenberg and Weaver recused from that matter.
Board counsel Randall J. Forbes appeared for the Board in these matters; respondents and counsel appeared as noted in the minutes. Motions to accept the orders were moved and seconded by Board members and carried; in some matters the involved investigators abstained by recusal and did not participate.
