Board of Pharmacy moves to allow remote drop sites and create operational waiver process

Tyler Lach, executive director of the South Dakota Board of Pharmacy, presented proposed rule changes to article 20:51 that add a section for remote drop sites (authorized by Senate Bill 14) and an operational waiver process allowing pharmacies to request waivers to specified rules when an alternative is shown to be as safe or safer.
Lach said the draft rules were circulated to stakeholders, the rules review comment period closed June 15, and the fiscal note indicated no ongoing fiscal change from the proposed rules. He said waivers cannot apply to licensing, registration, education or examination requirements and that the board worked with the governor's office and LRC staff on language and form changes.
At the public hearing the board received comments from eight parties in writing and four oral commenters; the board considered stakeholder feedback and made some modifications before sending the final packet to the committee. Senator Howard moved and Representative Hanson seconded a motion to deem the rulemaking process complete; roll call was unanimous and the chair declared the rulemaking process complete.
