Code Compliance Board imposes fines for ongoing code violations at Wallace Road lot

The NSP Code Compliance Board voted Feb. 20 to impose enforcement fines on the owner of a vacant lot on Wallace Road after staff reported the property remained out of compliance.

Dawn Parks, who presented the case, said the special magistrate previously found Homer and Myra Williams (or an associated entity) in violation of LDR 504.01 and gave earlier deadlines for correction. Parks said the property still contained “a we'll call it a dirt mound slash debris pile that stands approximately 8 foot tall and may be approximately 20 feet wide” and that some stored materials had been mixed with earth.

Parks told the board that the magistrate's order had been posted and certified mail accepted, but inspections on Feb. 1 and Feb. 20 confirmed the site remained noncompliant. She recommended imposing a fine of $100 per day commencing Nov. 22, 2024, continuing until full compliance but not to exceed $15,000.

A board member moved to accept staff's recommendation; the motion was seconded and passed on a roll call that recorded affirmative votes from Dan Coffer, Clifford Warren, Albert Szymanski, Aaron Dennis, Kathleen Brown and Ruth Kazmarek. The board ordered the respondents to contact the code inspector to verify compliance and noted respondents have the right to appeal the order within 30 days under Florida State statute 162.11.

The chairman also reminded the board that any violation of the same code within five years of the date of the order will be treated as a repeat violation and may carry fines up to $500 per day.

The board's action applies to case CCSM0624-2024 (parcel number 732401000102). No further schedule for this item was announced.
