The Waukesha City Plan Commission unanimously approved a conditional use permit Aug. 27 allowing a home-industry wholesale cigar business to operate at 3725 Stillwater Court.
Charlie, a city staff presenter, told the commission the applicant seeks to buy cigars wholesale and sell them on a limited basis to friends and family, with all sales delivered rather than conducted on-site. Staff said the request does not qualify as a permitted home occupation because stock-in-trade will be sold rather than manufactured on the premises, so a conditional use permit is required. Staff recommended approval with conditions, including delivery-only sales and limits on expansions or different tobacco businesses at the address.
During public comment, homeowner and homeowners-association board member George Jers said the association did not object. Applicant Jim Ginther told the commission the property address on the materials was incorrect and confirmed his address as 3725 Stillwater Court. The commission noted the homeowners association's support in its discussion.
The motion to approve, subject to staff conditions (including that sales be by delivery only and that the applicant hold any required cigarette and tobacco retailer license), passed by voice vote with no opposition. The commission did not record individual roll-call votes; the chair announced the motion passed unanimously.
