Conservation Commission issues multiple determinations, continues several coastal and redevelopment hearings

At the June 18 meeting the Commission issued determinations (including a Positive 2b for railroad vegetation management and several Negative 2s), continued multiple shoreline and revetment hearings for plan revisions and NHESP review, and set dates for follow-up.
The Conservation Commission on June 18, 2026, handled a docket of resource determinations and permit continuances spanning RDAs, Notices of Intent and Certificates of Compliance.
Commissioner Bradford Bower moved, and the Commission carried 6‑0, to issue a Positive 2b determination for TEC Associates’ filing on vegetation management along the Massachusetts Coastal Railroad right‑of‑way because the submitted maps did not provide adequate detail to confirm wetland boundaries and no representative was present to answer questions. Commissioners discussed drafting a comment letter to TEC to request clearer, current mapping.
Lynne Hamlyn of Hamlyn Consulting represented an RDA for 35 Ocean Avenue and the Commission issued a Negative 2 determination (flood‑zone only). Several other Negative determinations were granted after applicants confirmed limited impacts or NHESP exemptions.
The Commission continued a number of Notices of Intent to allow for plan revisions, NHESP review or alignment with related Waterways hearings: Atlantic Coast Engineering’s pier proposal at 104 & 110 River Street was continued to July 16, 2026 to match the Waterways hearing schedule; BSC Group matters for 703 Route 28 and 286 South Sea Avenue were continued to July 21, 2026 for NHESP comments and revised plans. Several Shorefront Consulting seawall matters were continued to July 21, 2026. Commissioners asked engineers to clarify erosion, mapping, and drainage details; for example, Commissioner Elly Tierney raised concern that adding revetment at 679 & 681 Route 28 could exacerbate scour caused by constricted flow under the Route 28 overpass. Dan Ojala of Down Cape Engineering said the design locates toe stones below the line of scour and that stones will be oriented to create a rough face; he agreed to investigate an apparent drainage pipe and provide clearer erosion edge measurements.
On certificate-of-compliance business, the Commission continued SE83‑2310 (52 Wilfin Road) to October 1, 2026 for removal of lawn and planting of native ground cover as requested by the Commission; a separate matter from Ryder & Wilcox resulted in a conditional Certificate of Compliance pending confirmation of seeding.
Other procedural business included a requested correction to June 14 minutes to record Commissioner Christian Bova as present; Commissioners also thanked Commissioner Patricia Mulhearn for her service and approved adjournment at 7:11 p.m.
All motions and continuances were recorded with unanimous votes when taken; the Commission set specific follow‑up tasks and dates for revised plans and NHESP comments where required.
