Council approves new Charles Washington Hall rates, tables waiver for downtown events

The Charles Town City Council on Jan. 21 approved updated rental rates and a uniform security-deposit policy for Charles Washington Hall but postponed a decision on a proposed fee-waiver program for businesses and nonprofits.
The council voted to adopt the revised fee schedule and a $200 security deposit to be returned after an inspection, actions staff said are intended to cover baseline staffing and utility costs. "We will require a $200 security deposit for all events regardless of what it is, and this deposit will return upon inspection of CW Hall,"staff explained during the presentation (attributed in the record to the hall manager).
The meeting then turned to a long debate over an "engagement waiver" that staff drafted to allow in-city businesses or nonprofits to request a waived rental fee when the event is promoted broadly and the city co-hosts or co-promotes the event through Charles Town Now. Supporters said the waiver or a reduced fee would encourage downtown businesses to hold public events and boost foot traffic. Opponents warned that a waiver could create unequal treatment and constitutional risks if religious organizations were excluded; one council member noted concerns about distinguishing which businesses qualify for a waiver.
Council members, city staff and representatives of Charles Town Now debated whether the benefit should be limited to downtown businesses, to locally owned operations, or opened to any in-city business that meets the public-promotion requirement. Several members suggested a smaller, predictable discount instead of a full waiver; another proposed keeping the nonprofit discount but removing a categorical exclusion for religious organizations. Council members asked Charles Town Now to return with a memorandum of understanding explaining how co-hosting and promotional support would work.
After extended discussion the council approved the fee and deposit changes and voted to remove the waiver language from the packet for now, effectively tabling the waiver while directing staff to refine the policy and to work with Charles Town Now and the council for clearer criteria.
Next steps: staff will return the revised policy without the waiver provision and Charles Town Now will be invited to explain proposed co-hosting responsibilities and a potential MOU at a future council meeting.
