The Limerick select board on an administrative vote authorized listing agreements for town-owned properties and asked staff to standardize broker commission language to a six-percent arrangement that can be split between listing and buyer agents.
The action came after a presentation by Casey Gray, a real estate agent with RE/MAX Coastal, who reviewed recommended terms for several lots and recommended against dual agency when she represents the town. "I, Casey Gray, cannot represent the buyer also because I'm here representing the town," she told the board, explaining past practice of a 6 percent total commission shared 50/50 to avoid vicarious liability.
Why it matters: The town holds roughly 140 tax-acquired or settlement properties that the board expects to list in phases; members said consistent commission and conflict-of-interest rules will speed sales and reduce legal exposure. S2 (staff member) told the board the town recovers administrative costs, commissions, legal fees and deed expenses from sale proceeds.
Board members debated commission structures after a briefing that one broker's form would pay 4 percent to the listing side plus an additional 3 percent if the buyer were unrepresented. Committee member S5 said that total approach (7 percent) was unfair to buyers without agents; board discussion settled on asking brokers to present offers with a maximum combined commission that can be split with buyer agents.
The board voted to accept a specific listing submitted for review (Sheila Helmuth’s proposal) and to have staff request changes to the commission language to align with the standard recommendation. The board also voted to authorize Casey Gray to list Map 38 Lot 3 (Fisher Drive) with a recommended price the agent provided in the packet.
Board members and the presenting agent emphasized disclosure and title work: Gray said packet materials will include deed and flood-zone maps and cautioned the town should not sign certain seller disclosures. The board also noted one parcel is constrained by a prior settlement that requires it be retained as recreation land; changing that would require notifying interested parties and amending the settlement and subdivision records.
The board signed the approved listing agreements and related policies at the meeting; staff said they will email the brokers with the requested commission-change language and distribute the finalized listing instructions.
Next steps: Staff will follow up with brokers to finalize commission language, post the listings under the revised terms and present offers at a future board meeting.
