Mantua council rejects notice of intent to begin dissolution of local justice court

The Town of Mantua Council voted unanimously on June 18 to reject a motion to submit a July 1, 2026, Notice of Intent to dissolve the Mantua Justice Court.

Council Member Henry Dovey moved to submit the notice; Council Member Scott Ross seconded. The motion failed on a 0–5 recorded vote (No: Mayor Annette Ash, Mayor Pro Tempore Matt Jeppsen, Council Members Scott Ross, Cheryl Burgan and Henry Dovey). The failure means the council will not initiate the statutory dissolution process by the July 1 deadline.

Staff and councilors reviewed options laid out by the Administrative Office of the Courts (AOC). Entering an interlocal agreement with Box Elder County would render Mantua’s municipal court dormant but would not formally dissolve it; by contrast, full dissolution would transfer future municipal case adjudications to Box Elder County and terminate local court operations. An operational audit presented at the meeting found the court to be running at a net deficit and noted that 99.5% of defendants during the prior fiscal year were non-residents, with only five cases involving Mantua residents.

The council also discussed contractual constraints: the municipality is bound by a two-year obligation to the sitting judge, a factor staff said limits near-term savings from dissolution. Staff outlined revenue and liability trade-offs among a full dissolution (which would forfeit local fine and forfeiture revenue to the county), hybrid or interlocal models (which could use a 50/50 revenue split), and the administrative costs the town would retain under each model.

Because the motion failed, no further action to file the Notice of Intent was taken that night. Council members said they would continue reviewing operational and financial impacts before taking any future binding steps.
