Trustee Joost made the motion in open session after the board returned from closed session, saying the motion authorized the superintendent to "work with legal counsel to reach a resolution with Weber Commercial Construction LLC, and enter into a settlement agreement pursuant to the terms discussed in closed session." Trustee Torres seconded the motion. The board approved the motion by voice vote, 7–0.
The board had announced in open session that its closed-session topics included consultation with counsel on legal issues and contractual claims related to Weber Commercial Construction LLC involving construction work at Carpenter Elementary, Bowes Middle School and an agricultural facility, and referenced the consultation code under the Texas open-meetings statutes. No settlement terms or dollar amounts were made public in open session.
The board’s authorization directs the superintendent and district counsel to finalize a settlement consistent with the terms reviewed in closed session and to report back to the board when the agreement is completed.
