Council approves settlement agreement with developer QMC and neighbor Grampa

City Attorney Joanna summarized the background: a developer (identified in the resolution as QMC/Cortera) applied for permits for a mixed-use project; three separate appeals were filed, two were dismissed as insufficient SEPA appeals, and an appeal by neighboring property owner David Grampa remained pending. Joanna said the parties (QMC, Cortera and Grampa) reached a signed settlement and staff recommended council approval. She told council the settlement, as reviewed by city staff and the attorney's office, contained no monetary obligations for the city and chiefly documented that the parties’ agreed items remain within the scope of the original permits.

Joanna asked that council convene an executive session under the statutory citation given in the meeting (recorded in the transcript as “RCW 42 31 10 subsection 1 I”) to discuss litigation; council recessed for an executive session and returned roughly 10 minutes later. Councilmember Frazier moved to approve Resolution 1883 and authorize the mayor to execute the agreement; the motion was seconded and passed by voice vote.

The resolution, as read by the city clerk, names QMC/Cortera, Ennequois Holdings LLC and David Grampa as parties; the transcript contains no dollar figure for any city payment and the city attorney stated none exists in the agreement. Council authorized the mayor to sign the agreement following the executive-session review.
