DIDS board reviews SB407 and AB541, noting appointment and funding changes
Summary
Department staff told the board SB407, effective July 1, 2025, changes appointment authority for the state public defender and AB541 transfers post-conviction funding to DIDS, a move staff said will let the Nevada State Public Defender spend more time on clients.
Executive Director Peter Handy briefed the board on two pieces of legislation from the 2025 session that affect indigent defense administration.
Handy said SB407 will become effective on July 1, 2025, and that it modifies the appointment process: the DIDS executive director will appoint the state public defender and the state public defender may serve multiple terms; the change also allows the Board or Director to conduct a nationwide search for qualified candidates.
Handy described AB541 as largely administrative: it transfers the funding that the Nevada State Public Defender previously used for post-conviction work into the Department of Indigent Defense Services account. He said the transfer should free NSPD staff to spend more time directly with clients.
Board members asked questions about the bills' effects; Handy summarized the bills' history and said he was not aware of substantive pushback in the legislative process. Because review of the legislation was a non-action item, the board did not take a formal vote on either bill at this meeting.
