Barbara Zakzewski of 65 Marion Avenue told the Town Board she and her disabled husband have endured more than three years of repeated flooding tied to a town easement and storm‑drain pipe. Zakzewski said the town’s promised repairs have not materialized despite engineering work, legal correspondence and meetings with staff and that the situation has caused significant hardship.
"It's been over 3 and a half years... I thought Mr. Feiner would fix it," Zakzewski said, describing gushing water into a garage and basement after a prior storm and saying the family has had to gut and rebuild basement space.
The town explained the matter is subject to legal review and easement/contract constraints. The town attorney told the board he had written to counsel today and hoped to resolve the issue and return it to the Nov. 25 Town Board agenda for further action. The supervisor stressed staff compassion for affected residents but noted the town must comply with applicable law before taking physical action on an easement.
TB7 (a resolution related to the item) was held over and will be revisited at a future meeting while staff continue legal and technical review.
Next steps: town counsel and public works to continue review and the item is expected back before the board at the next meeting for further consideration.
