Council approves amended use permit for Mario & Luigi at 7145 Main Street with patio conditions

The Clifton Town Council on July 3 approved an amended use permit letting Mario & Luigi, LLC expand its space at 7145 Main Street to add a pizza takeout service and a small market, subject to multiple conditions. The Planning Commission recommended approval after reviewing the applicants' representations and site plans.
The Council recorded that the applicants, Marcus Silva and Salvatore Speziale, proposed an expansion of about 450 square feet and told the Commission that "the space will not be used as an eat-in restaurant," with no more than two employees and the hours set to match the primary restaurant: Sunday through Wednesday, 11 a.m. to 10 p.m., and Thursday through Saturday, 11 a.m. to 12 p.m. The Planning Commission also recommended assigning two additional parking spaces to the business, bringing the owner's total on the property to 19 spaces. Councilmember Wayne Nickum moved to adopt the Planning Commission recommendation; Mayor William R. Hollaway seconded, and the motion carried.
Council also approved, with conditions, plans to construct additions and screening walls around an existing patio to create a private outdoor seating area. The Planning Commission's approval is contingent on the applicants providing a surveyed plat showing that the exterior patio structure meets the minimum 10-foot side-yard setback from the Heilmann property before the mayor signs the permit documents. The Commission noted that no structure may be built on the portion of the property abutting Ayre Square because the existing fence there is nonconforming under Section 9-16b2 of the Code; any replacement fence in that area must be six feet or less. The Council's motion approving the patio plans was made subject to the mayor receiving the required plat.
Dwayne Nitz said the applicants do not need permission from the Ayre Square property owner to alter landscaping along the Buckley Store property line but advised they should notify the owner; Mr. Silva and Mr. Speziale are scheduled to appear at the August Town Council meeting to present their final plan.
Next steps: the mayor will not sign the amended use permit for patio structures until the required surveyed plat is submitted and verified as meeting the 10-foot setback requirement.
