The North Vernon City Council voted to remove a commercial restriction at 760 South State Street after a property owner described the building as a long-standing commercial site unsuited to conversion to a residence.
The owner, identified in the transcript as Brian Bailey, told the council the building has an asphalt parking lot and limited interior space and that it had been commercially used for roughly 25 years. Neighbors and another resident raised concerns about an amended covenant they said appears in county records without clear provenance.
A resident urged that removing the restriction should not permit uses that would be disruptive to the neighborhood; staff and council members said existing business-permit, area-plan, and code-enforcement processes will continue to apply to any future tenant.
A motion to remove the restriction on 760 South State Street was made by Jared and seconded by Baron; the motion carried unanimously (5-0).
