Milford agency unanimously releases inland-wetlands violation after owner posts bond, secures permit

The Milford Inland Wetlands Agency voted unanimously July 15 to release a June 4 violation for unpermitted work and insufficient erosion controls at a property on Naugatuck Avenue after the property owners posted bond and obtained the required inland-wetlands permit.

Mary Rose, speaking for agency staff, told commissioners the order had been modified at the agency’s June 17 meeting to require weekly sedimentation-and-erosion-control reports and reports after significant rain events. "The property owners have posted their bond and taken out their inland wetland permit for the project," Mary Rose said, adding that the permit carries the same erosion-control requirements and that the site would remain under monitoring.

Commissioner Julie Valvo moved to release the violation "based on the fact that everything has been satisfied. And moving forward, we can monitor everything through the application," she said. A fellow committee member seconded the motion.

A second committee member who said he drives by the site daily told the board, "They've been doing a great job, so I don't really foresee any reason to keep the violation in place." The agency then held a roll-call vote; the clerk recorded unanimous approval.

Mary Rose said the office will send a confirmation letter to the property owners notifying them the violation has been released.

The agency’s action releases the formal violation but leaves monitoring and compliance responsibilities in place through the permit and periodic reporting required by staff. No fines or additional enforcement actions were announced at the meeting.
