A property owner applied to extend water service for lots north of Dune Street on the east side of US‑158 where a gap exists in the water main. Town staff asked the board on Nov. 6 to (1) amend the ordinance (section 44‑108) to lower the eligibility threshold from 500 feet to 250 feet so the lot in question qualifies for the code’s owner‑funded extension process, (2) approve an agreement between the town and the property owner establishing a cost‑share/reimbursement mechanism, and (3) approve a $48,309 budget amendment to allow the extension to proceed in advance of the next meeting.
Staff said the code provides multiple processes for extending water: a statutorily authorized extension assessed to adjacent property owners, or an owner‑funded extension where the owner pays upfront and future adjacent owners who connect within 10 years reimburse a portion of the cost. The property at issue is closer than the existing 500‑foot threshold; staff recommended lowering that threshold to 250 feet (a change staff said has historical roots and no clear origin in the record) so the owner could use the owner‑funded extension option.
The board moved, seconded and approved the ordinance amendment, the owner agreement and the $48,309 budget amendment by voice vote. Staff said the town will bid the project, adjust final costs based on bids and return any overage or shortfall consistent with the agreement terms.
