Hudson council authorizes alley vacation process, schedules public hearing for July 27, 2026

The Hudson City Council authorized staff to begin the formal process to vacate an alley between 4th and 5th Streets after staff reported the alley was vacated in the early 1990s but that adjoining property owners were not awarded their halves of the alley in the original vacating instrument.

Staff member (S2) explained that the alley was vacated in 1991–1993 but the vacating instrument did not grant adjoining property owners their portions; the Iowa Code now requires that, when a city vacates an alley, the adjoining owners be awarded their portions. Staff recommended proceeding with a proper vacating process while retaining easements for existing sanitary sewer and other infrastructure.

"The Iowa code section now says that when a city vacates an alley, they shall award the adjoining property owners with that portion of the alley that is, you know, one half of the alley closest to their house," Staff member (S2) said. Council members discussed practical effects for a resident who requested additional lot width to build a larger garage and noted that vacating the alley may not fully resolve setback or variance needs but could provide the adjacent owner additional land.

Council moved, seconded and approved proceeding with the vacation process and set a public hearing on the matter for July 27, 2026 at 6 p.m. (Resolution 34-73). Staff said the vacating instrument will retain easements needed to preserve sewer and other city infrastructure.
