Wakefield Public Schools and certificated employee Matt Farup reached a settlement in May 2026 in which the district will pay Farup $155,000 and accept his resignation effective June 30, 2026, according to the signed agreement.
The settlement says the district will pay Farup all salary and benefits due through his final day and an additional $155,000 on a mutually agreed schedule on or before June 30, 2026. Those sums are subject to legally required payroll deductions, including federal and state income tax withholding, FICA and FUTA; the agreement specifies the additional payment will not be reduced by employee contributions to the Nebraska Public Employees’ Retirement System.
Under the agreement, Farup will perform his duties remotely from the date of execution through June 30, 2026 and has agreed to waive claims to payment for accrued but unused vacation, paid time off, or other leave benefits that might otherwise be payable on separation.
In exchange for the payments and other promises, Farup releases the School District and its officers, board members, administrators, employees and agents from all claims related to his employment or its end. The release expressly cites statutory and regulatory sources by category, including the Nebraska Wage Payment and Collection Act; Neb. Rev. Stat. §§ 79-824 through 79-842; Title VII of the Civil Rights Act of 1964; the Age Discrimination in Employment Act; 42 U.S.C. § 1981 through § 1988; the Americans with Disabilities Act; § 504 of the Rehabilitation Act; the Family and Medical Leave Act of 1993; and the Nebraska Act Prohibiting Unjust Discrimination Because of Age. The agreement states Farup represents that no claims have been filed.
The document notes that, while the agreement does not prevent Farup from filing a charge with the Equal Employment Opportunity Commission or similar state agencies, he would be entitled to no relief, reinstatement, back pay, front pay or damages from the School District under the terms of this settlement if he files such a claim.
The settlement includes a letter of recommendation for Farup (identified as Exhibit B) and directs that all communications with prospective employers be routed to the Wakefield Community Schools Board President and handled consistently with that exhibit. The agreement also states the School District may advertise for and hire a replacement immediately.
The settlement informs Farup in writing that he should consult an attorney, that he has 21 days to consider the agreement and seven days after executing it during which he may revoke his acceptance. The signature block includes lines for Matt Farup and Jeff Keagle, identified as School Board President, with dated lines showing placeholders in May 2026.
Next steps: the resignation is effective June 30, 2026 per the agreement; the School District may proceed with recruiting a replacement and will provide the additional payment on the schedule the parties agree to.
