Borough solicitor finalizes sidewalk-seating draft; commission seeks 3 ft. 6 in. accessible path requirement

Chair Jamie Joyce said the draft incorporates the borough’s prior temporary (COVID-era) seating rules but removes references to parking lanes in the ordinance title and text. Commissioners and staff agreed the draft should explicitly require a clear accessible path of at least 3 ft. 6 in. past any seating area on sidewalks.
Staff said they will send the finalized draft to commissioners for review and that further refinements can be considered before the item is advanced to council. No formal vote was taken; the commission requested circulation and a future substantive review.
