Nye County district attorney says hospital district loan agreement was unauthorized; county negotiating interim arrangements

Officials told the Committee on Local Government Finance that a 12/21/2022 loan/grant agreement by the Northern Nye County Hospital District, which provided a $500,000-per-year line of credit with forgiveness terms, lacks statutory authorization and has been repudiated.
Lynn Lukacs, the department’s budget analyst assigned to Northern Nye County Hospital District, said the agreement allowed the contractor to draw up to $500,000 each year without repayment obligations while continuing to provide required medical services; the contract included forgiveness of 25% of outstanding draws at the commencement of each year if the contractor was not in default. Lukacs said the department was not made aware of the agreement until it received the FY2023 audit on 07/25/2024 and that NRS 450 (as cited in the hearing) provides no authorization for a hospital district to make such loans.
Nye County District Attorney Bridal Coonsie told the committee the finding came from his office’s investigation, described similar agreements as "completely illegal," and said the county has repudiated those agreements. Coonsie said the county is negotiating interim, month-to-month arrangements with the clinic provider while final agreements that address the legal issues are finalized. "These these agreements are completely illegal," he said, and added that his office is actively working to get final, legally compliant agreements in place.
Committee members thanked the Nye County representatives and expressed that the matter appears to be resolved for now; the county DA said he will continue to be personally involved in finalizing compliant agreements. The committee did not take a formal enforcement vote at the meeting.
