Council approves amendment to allow townhomes as special use in C-2 and C-3 zones

The Ely City Council on June 12 approved the second reading of Ordinance 762 (Bill 2025-02), amending the municipal code to add townhomes as a permissible special use in C-2 General Commercial and C-3 Highway Commercial districts.
City Building Official Don Hendrickson explained the amendment is a correction to existing code language that had defined "apartment house" as a single-story structure and did not properly account for multi-story townhouses. "It was discovered that in our ordinances we have apartment houses identified. The definition of an apartment house is a single-story structure, and townhouses are multi-story structures. So, this is an update and correction to our Code to allow those townhomes in our zoning," Hendrickson said.
A member of the public, George Chachas, said he was surprised the item did not come before the Regional Planning Commission and suggested the matter be routed there in the future; Building Official Hendrickson said the code correction is a City matter and does not require Regional Planning Commission approval. Council voted unanimously to approve the second reading and adopt Ordinance 762.
The change allows townhomes as a special-use category in the two commercial zoning districts but does not make them a permitted use in C-1 Neighborhood Commercial districts.
