At its July 15 meeting the Conservation Commission reviewed a notice of violation for an above-ground fuel tank and concrete pad installed at 100 Tearingham Road without permits.
The owner/representative explained the pad was placed on the surface and that the tank is removable and anchored. He said he had expected a contractor to pull permits but they did not and that he is now arranging permitting himself: "I'm doing it now myself to prevent any ...", he told the commission.
Commissioners asked whether the tank and pad were inside the 100-year floodplain and whether anchors and emergency shutoffs were provided. The owner said the electrical and fire departments had signed off on their elements, but confirmed no building permit was pulled and that he intends to submit an after-the-fact RDA. Staff noted the commission must determine whether the pad and tank meet floodplain and riverfront rules and requested elevation and permitting details before final action.
Members discussed enforcement approaches and agreed to accept a submitted after-the-fact RDA as a likely path to resolve the violation, and to send a notice letter to the contractor stated to be involved. The commission asked staff to follow up and to place the RDA for review once submitted.
Next steps: owner to submit required permit/RDA paperwork; staff to send a notice and review the after-the-fact RDA at the next commission meeting.
