Board authorizes committee to award Mills Pond contract, addresses easement and wholesale-negotiation updates

At the Dec. 16 meeting the Wells Branch Municipal Utility District Board directed a committee to proceed with awarding a contract for Mills Pond regulatory improvements and discussed related legal and interlocal issues.
District engineer Jason Baze reported the Phase 2 ATLAS 14 priority pond maintenance kickoff had taken place Dec. 1 and informed the Board that five bids had been received for the Mills Pond regulatory improvements project. General counsel John Bartram told the Board the Mills Pond item was not on the meeting agenda and recommended the Mills Pond Dam Ad Hoc Committee proceed with awarding the contract at the committee level, with the understanding that the committee’s action would be included on the next Board agenda for ratification. The Board voted unanimously to follow that recommendation (motion by Director Jon Klekman, second by Director Kevin Ward).
District Manager Shirley Ross reported an easement issue on Mocha Trail: an easement for the Willow Run pond had been granted to the City of Austin rather than to the District. Bartram said he would evaluate options for how the District should move forward. Bartram also reported he had seen email correspondence from John Carlton indicating negotiations related to renewal of wholesale water and wastewater service for Travis County Water Control and Improvement District No. 10 were ongoing but had made little progress.
The Board assigned correspondence with Wells Branch Owners Association, Inc. (the Commercial POA) to the Administrative Committee for follow-up after counsel’s update. The matters discussed were procedural directions and committee assignments; no binding change to wholesale contracts or easement status was recorded at the meeting.
