The Greenburgh Planning Board on May 21 set a public hearing for June 4 on a proposed two‑lot subdivision at 134 Euclid Avenue after the applicant received a jurisdictional determination from the New York State Department of Environmental Conservation.
Applicant representative Jacob Amir said DEC responded that the subdivision itself is not a regulated activity under DEC rules but that any future development or alteration within the 100‑foot wetland buffer would require a DEC wetland permit. Staff and the applicant explained that approximately 8,700 square feet of the project’s limit of disturbance would fall inside the 100‑foot buffer if a house were placed where zoning setbacks require. The proposed subdivision includes a mitigation/landscaping plan — 22 trees and 41 shrubs heavily weighted toward native species — and a stormwater design sized to the 50‑year storm event (Cultec infiltration chambers) that staff said exceeds town minimums.
Staff told the board the Conservation Advisory Council had reviewed and recommended the mitigation planting plan with suggested species changes that the applicant accommodated. The applicant said some plantings will be on neighboring property and agreed to obtain permission where required before implementing off‑site plantings. The board advised the applicant to engage the adjacent neighbor(s) early; staff said a DEC wetland permit will be required prior to any regulated activity in the buffer and recommended conditioning future approvals on filing evidence of that permit when applicable.
What’s next: The board placed the matter on the June 4 public hearing calendar. Staff will prepare a SEQRA (SEEKER) determination for the board’s review ahead of the hearing and will circulate notice and mailing labels; the applicant will gather neighbor labels and any necessary off‑site planting permissions.
