Board approves red-line lease with Pueblo of Pojoaque to advance middle-school project

The Pojoaque Valley Public Schools board voted Sept. 24 to accept red-line edits to a land-lease agreement with the Pueblo of Pojoaque that administration said would allow the district to submit a signed lease to the Public School Facilities Authority (PSFA) to seek additional square footage for a planned middle-school project.
Superintendent Dr. Segura told trustees the Pueblo's general counsel characterized the lease as "a strong lease agreement," and noted the Pueblo is scheduled to consider the lease at its Oct. 2 meeting. The administration said PSFA requires a signed lease before the district can pursue the additional square-footage allocation that would enable the middle-school construction to proceed.
Key lease points highlighted in the red-line review included language preserving the district's right to exchange land and water rights of comparable market value, and a negotiated lease-rate phrase that administration said met the district's request. During the presentation the superintendent summarized agreed language and said the parties had negotiated market-value parity for any land-and-water exchange.
A trustee asked for care in confirming the exact parcel proposed for exchange and suggested resolving parking and access issues on the candidate parcel if the swap takes years to complete. The superintendent said the district's legal counsel and the Pueblo's counsel had worked through language designed to protect district interests and to make the project eligible for PSFA review.
The motion to approve the red-lined lease language and move forward for PSFA submission was made, seconded and carried.
Next steps: the Pueblo of Pojoaque will consider the lease on Oct. 2; if the district receives a signed lease back it will submit the document to PSFA to request increased square footage and continue project planning, including a PSFA presentation and any required environmental or site-clearance steps.
