Committee approves comprehensive Chapter 9 revisions to align with Act 73 and clarify licensing rules

City staff presented a broad set of amendments to Municipal Code Chapter 9 on May 11 intended to bring local rules into alignment with state Act 73 and to clarify administrative procedures. Brian (city staff) walked the committee through proration language for multi-year operator licenses, a conditional-license process for premises under construction, and an explicit 60-day process for reissuing a license when a bar is sold so new owners have certainty during ownership transitions.
The draft also introduced a process for full-service retail (FSR) permits that will mainly be administered by the state Department of Revenue while preserving limited city oversight of the licensed-premises definition and product restrictions. Staff recommended deleting or relaxing several archaic or redundant provisions (for example, certain restrictions on credit sales and carryout fermented malt beverages) and exempting class-A cider-only licenses from the city’s class-A quota so the ordinance complies with state chapter 125. For temporary event premises, staff proposed easing the requirement for a physically substantial permanent barrier and allowing signs or monitored entry/exit as sufficient delineation in many temporary cases.
Committee members asked clarifying questions and discussed prior ad hoc practices; staff said the draft attempts to set objective standards and to make enforcement and applicant compliance simpler. The committee moved to approve the proposed revisions as written and voted unanimously to forward the package to council for final consideration.
The changes will be forwarded to the May 19 council meeting and staff said they will work with clerk’s office to finalize any redline updates requested by council prior to adoption.
