Board told to rescind earlier PW resolutions and reapprove revised sewer-easement agreements

Town staff and the town engineer’s office told the Greenburgh Town Board that two prior public works resolutions need to be rescinded and replaced because property owners requested changes to sewer-easement agreements.

A town engineer representative explained that the property owners requested amendments to the terms of the agreement, and the changes — while described as small — were significant enough to require reapproval. The board was told the correct approach was to rescind the prior resolutions (PW1 and PW2 from July 9) and adopt revised resolutions attached to the updated easement agreement.

A staff member confirmed the change affects multiple parcels (some split into two parcels for tax/resolution purposes) and said the resolution headings contained a typographical error that would be corrected (AT2 was mislabeled and should reference a different petitioner/parcel). Staff provided a parcel address for one changed petitioner — 49 East Sunnyside Lane — to clarify which property was referenced.

"The property owners requested some changes to the terms of the agreement... significant enough that we need to reapprove the new version," the town engineer’s office said. The board asked for the corrected resolution headings and for staff to double-check any necessary amendments before the formal meeting.

No formal vote to rescind or reapprove was recorded during the work session; staff said the revised resolutions and corrected headings would be prepared for the formal board meeting where members can act.
