Planning board approves homeowner request to assume maintenance of Carriage Hill stormwater basin

The Town of Greenburgh Planning Board on Sept. 17 approved a request to amend a previous condition of approval for PB-14-35 (Carriage Hill / Drago Way) so the property owner would assume responsibility for maintenance of an underground stormwater basin rather than the homeowners association.
Attorney Steven Bridal, speaking for the property owner, told the board the HOA had not been formed and the recorded documents did not create an enforceable obligation on the HOA to perform basin maintenance. Bridal said the owner would record a stormwater maintenance agreement and an easement running with the property to guarantee ongoing maintenance, repair and replacement.
Deputy Commissioner Schmidt confirmed the original approval had placed maintenance responsibility with the HOA. After questions from board members about how the change would be recorded and enforced, a member moved to approve the amendment; the motion was seconded and carried by voice vote, with the chair recording an aye vote.
The applicant agreed to record the maintenance and easement documents in the land records so the obligation runs with the property. The board did not attach additional conditions beyond the recorded agreements; staff will confirm recordation as part of permit compliance.
The amendment is administrative in nature and does not change the project's constructed elements. The board treated the matter under its correspondence/consent portion of the agenda and completed the vote on the record that evening.
