Council approves vacating a right-of-way in Astra Enterprise Park, contingent on substitute dedication

Council adopted ordinance No. 2687 to vacate a platted right-of-way in Astra Enterprise Park to accommodate a proposed sale; counsel said the city will not record the vacation until a substitute right-of-way is dedicated.
City counsel explained that when the plat for Astra Enterprise Park was approved a right-of-way for Stringtown Road was included on the plat. Sunflower Redevelopment is discussing a sale that requires vacating a portion of the right-of-way; state statute requires a public hearing and a vote to vacate dedicated right-of-way.
Counsel told council that two findings must be made: that the vacation would not inconvenience the public and that justice requires the vacation for the applicant. The city also will require a substitute right-of-way dedication before recording the vacation; deeds of dedication will be taken from Sunflower Redevelopment and the buyer will also dedicate a portion to ensure public access is maintained.
The mayor opened the public hearing; no one offered comment and the hearing was closed. A motion to approve ordinance No. 2687 carried by roll call.
