KDADS proposes changes to CSW service definitions and provider rules, keeps $20,000 annual cap

KDADS presented proposed changes to Appendix C of the Community Support Waiver on provider qualifications and service definitions, replacing earlier lifetime caps on certain goods with the legislature’s $20,000 annual limit per participant.
Elion said KDADS removed a previous $10,000 lifetime cap on home modifications, vehicle modifications and specialized medical equipment and supplies; under the current draft the only numeric limit is the $20,000 annual cap established by the legislature. "So now the only limit on these services would be the $20,000 annual cap set by the legislature for all CSW participants," Elion said.
KDADS also removed a requirement that assistive-technology vendors, home- and vehicle-modification providers and other specified suppliers affiliate with a community developmental disability organization (CDDO). Elion said those modification providers will not have to affiliate with CDDOs, while most other CSW service providers will still need CDDO affiliation.
The agency said it also aligned the training requirement for nonemergency medical transportation (NEMT) with the state plan by removing a separate CSW restraint/restrictive-intervention training requirement so that the same baseline training applies to state-plan and CSW transportation providers. Elion said the change was meant to avoid creating duplicate training obligations and to expand provider availability for transportation services.
KDADS removed a restriction that previously prevented other waiver services from being billed concurrently with individual employment support services; the draft also raised the allowable family caregiver support and training group size from three to four families.
KDADS staff said the $20,000 limit can be changed only by legislative appropriation and that exceptions to the annual cap are not included in the draft. The CDDO will be responsible for informing participants about the cap during options counseling and MCO care coordinators and TCMs will assist participants who need supplemental non-waiver services or who must consider transition to another waiver if CSW cannot meet their needs.
