A staff/agency official explained the change at the council meeting, saying the ordinance moves from piecemeal, location-based restrictions to a single, behavior-focused standard that requires anyone operating one of these devices to do so in a ‘‘reasonable, safe and controlled manner.’’ The measure retains state statutory limits (including age and class distinctions for e-bikes) and preserves parental liability provisions for minors.
Supporters told the council the prior sidewalk ban would have forced some riders on to busy roadways. The ordinance allows officers discretion to determine whether conduct is irresponsible rather than drawing bright lines based on speed thresholds. It also requires a rider passing a pedestrian to give a warning (for example, ‘‘on your left’’) and reiterates that pedestrians always have the right of way; officers may require a rider to dismount and vacate a sidewalk when necessary to prevent a collision.
The text excludes gas-powered mini-motorcycles and other devices that do not meet moped or e-bike definitions; those vehicles remain prohibited from streets unless licensed as mopeds or similar. The chief or the chief’s designee can designate temporary restrictions for special events or construction zones.
Council members and staff said the ordinance aims to be easier for the public to understand and more enforceable in the field. After discussion and questions about play-vehicle and private-parking exemptions, the council moved the ordinance to the floor and approved it by voice vote; there was no recorded roll-call and no opposition was recorded.
The ordinance will take effect as provided in the city code; staff indicated they will publish education materials and a demonstration video to explain new responsibilities for riders and merchants.
