Zoning commission grants fence variance at 303 West over two objections

The Zoning Commission voted 4-2 on Feb. 24 to grant a variance (V26-02-04) to CLURO §9.2.5.2 to allow a fence at 303 West.
Planner Alex Weiner presented the case and said he agreed with the report by Ladson Poole and that the fence posts “looked to be hand dug.” Nina Ward, the applicant, told commissioners the fence was started before she applied for a permit and that work stopped after she learned a permit was required; the back and side of the fence remain unfinished. Commissioners discussed whether removing and replacing the existing fence could harm a tree near the work and the typical process for after-the-fact permits and Mayor’s Court referrals.
Commissioner Karen Gautreaux moved to approve the variance and Commissioner Nicholas Cressy seconded. The motion passed 4-2, with Chairwoman Claire Durio and Commissioner Andrea Fulton voting against. The commission recorded the need to follow procedural steps to “tie up all the loose ends” before final closure of the file.
Vaughan Sollberger of KVS Architecture, retained by the Wards, said KVS will be involved in later phases of work on the property but noted that their involvement was separate from the narrow fence variance.
The Zoning Commission concluded its business and returned the meeting to the Planning Commission portion.
