Monroe County commissioners voted July 16 to approve a representation letter from the law firm Clark, Johnson & Knight to provide legal representation in an ACLU lawsuit affecting county officials.
County legal staff said the county attorney’s office would be conflicted out of representing named county parties and that Clark, Johnson & Knight performed a conflict‑of‑interest analysis and concluded it could represent both the commissioners and the sheriff without creating an ethical violation. The letter adds the sheriff as an additional client and keeps the same fee structure previously approved for related representation.
County staff said they have contacted the county’s insurer and expect a response within one to two weeks on whether the insurer will pay for the representation; staff also said the insurer had previously recommended or would appoint the firm if it covers the cost. Commissioners said they were satisfied with the firm and the arrangement, and they approved the representation letter by voice vote.
County legal staff noted that if the litigation evolves further the county attorney’s office might remain conflicted and would not be able to represent the parties directly.
