Lee Sobolik told the Minto City Council on May 12 that he intends to develop new housing on his property along Highway 15 east of Minto, and said an outside group would buy the lots and donate them to Red River CHDO (as named in the minutes). Sobolik said he expects to have a selling price for each lot by the end of the week.
City attorney Peyton Cole told the council the city could encounter an easement by prescription if it closes the west entrance to the nearby mobile‑home park as part of the development plan. Cole explained that an easement by prescription can arise when one party has used another’s property for a specific purpose over an extended period, with or without permission, and that while the city can close the entrance it could face legal action seeking to enforce such an easement.
Council members did not take formal action on the proposal during the meeting. The next steps recorded in the minutes are that Sobolik will provide selling prices for the lots by the end of the week and that city staff and legal counsel will need to evaluate access and easement risks before any closure or lot transfers proceed.
