Planning commission approves revised conditional-use permit for wetland-buffered home with added helical piles

The Cannon Beach Planning Commission voted to approve a revision to conditional-use permit CU2601, a modification of CU2507 that allows residential construction using an existing elevated steel frame in a wetland buffer at the corner of North Hemlock and 6th Street.
Planning staff told the commission the revised application would reuse an existing steel framework and yield a footprint of about 1,250 square feet while relying on roughly 2,470 square feet of driven structural framework already on the site. The applicant said structural analysis showed the existing beams could not carry the newly designed house without additional support, so the proposal adds about 20'121 hand-driven helical piles and limited concrete footings (roughly 10 square feet total). Staff emphasized hand excavation and manual placement where feasible to minimize wetland disturbance.
"We're truly trying to impact it as very little as possible," the project's designer said, describing a preference for hand-driven pilings instead of heavy machinery.
Wetland specialist Gabby Bender (Ecological Land Services) told the commission an updated wetlands assessment (dated Feb. 24, 2026) increased the proposed area of impact to 2,806 square feet and proposed a 1.01:1 area-based mitigation ratio, which she said meets the municipal code's area-ratio requirement even though it does not account for subsurface soil-column volume.
Several commissioners pressed the applicant and staff over process and prior approvals. Multiple commissioners said prior approvals had not clearly anticipated the structural changes and that more information about mitigation and inspections was needed. "I am really concerned that the engineering wasn't done initially so that we could assess the impacts altogether at once," one commissioner said during deliberation.
The commission approved the revision by roll call after a motion and second. Before finalizing conditions, commissioners agreed to re-open the record to allow the project engineer and wetland specialist to supply additional detail on mitigation measures and implementation steps, and staff noted the final decision timeline tied to the city's 120-day processing rules.
The commission's approval includes requirements tied to the wetland overlay standards and mitigation the staff report identified; staff will publish the precise conditions and any follow-up submittals required of the applicant. The commission indicated it expects an additional wetland-specialist mitigation proposal that specifies location and type of compensatory mitigation and any construction sequencing intended to reduce short-term disturbance.
The applicant team and staff said they will provide the additional materials requested and that they will comply with any inspection and mitigation provisions the commission sets.
