The Halifax Planning Board voted July 16 to release the $500 surety on Kenzie’s Path, a bond the board said is eligible for release because the town accepted the road at the 2012 annual town meeting.
The board moved and seconded to approve the release after a meeting participant provided copies of bank correspondence indicating funds could be placed into a state account if the town did not act. The motion authorized the chair to sign a certificate of the board’s action once the developer submits a written request — an email or letter — and a release document is prepared for the board’s records.
"I gave copies of the letters that I got from the bank," said the meeting participant (speaker 6), noting the bank’s warning about funds being moved if the town did not process the release. Several board members cited the 2012 town meeting as the event that formally accepted the road and argued that further engineering reviews would likely consume the entire $500 bond.
The motion passed on a voice vote. Board members said staff will prepare a record suitable for recording and that the chair may sign the release once the required documentation is in the file.
