Village water board asks commission to back transition to state regulation and a delayed effective date for compliance

A presenter for the village described a history of disputed billing and jurisdictional uncertainty for their water and sewer services and said the village requested regulation under a state board (referred to in the hearing as TPUC/T Board). The presenter said state legislation carried by local lawmakers and signed by the governor became effective July 1 and that the village now seeks county support and an implementing resolution with an effective date of Jan. 1, 2027 to allow time to upgrade systems, train board members and align accounting practices.

"We do wanna be regulated," the presenter said, adding the state board route offers simpler procedures and consumer protections without the need for costly legal processes. He described master-meter arrangements (four master meters from one utility and one from another) that prevent individual customers from receiving service directly and said the village will need time to meet accounting and training requirements imposed by the state regulator.

County staff asked whether the two county mayors must sign; staff and presenters said they expect interjurisdictional coordination and that the item will return for formal action. Commissioners noted the county itself does not own or operate utilities in many areas and cannot force LCUB or other utilities to extend service. The presenter asked the commission to sign a resolution supporting the regulatory transition and to permit a delayed effective date of Jan. 1, 2027 to allow compliance work and system upgrades to proceed.
