Sewall's Point — The Town Commission on Oct. 22 approved the first reading of Ordinance No. 470, which revises marine-structure rules to add a definition for "dock gazebos," provide for nonconformities and add standards for dock structures and boatlift covers.
Town Attorney (read by the attorney) described the ordinance as an amendment to Chapter 62 (marine activities) to add definitions and technical requirements. Building Official Jack Reiser clarified that the ordinance applies to structures on docks and does not change DEP authority over dock approvals.
Commission discussion identified typographical and drafting issues — for example, the packet referenced "boat lift cover" where the drafters intended "dock gazebo," omitted the word "sided" in the definition of an open-sided dock gazebo, and included the phrase "in all probability" in an engineering requirement for wind resistance. The commission directed staff to correct the typographical errors and strike or revise unclear engineering language before the second reading.
The commission voted to approve the first reading with the edits discussed.
Why it matters: The changes clarify which dock structures are permitted, reinstate previously allowed covered structures in certain parts of town (subject to special permit and height limits), and establish engineering and permitting expectations for covered boat lifts and dock gazebos. Building staff said some nonconforming structures existing today would not be permitted to be rebuilt if destroyed; repairs to existing nonconforming structures are allowed within limited parameters.
Next steps: Staff will incorporate the agreed edits and bring the ordinance back for second reading and final adoption.
